1. Acceptance of the Licence Terms
By installing, activating a Licence Key, launching, or using the SmileCrop application, the User confirms that they agree to these Licence Terms. If the User does not agree, they must not use the Application.
2. Nature of the Application
SmileCrop is a desktop application intended for automatic cropping, sorting, renaming, and organization of photographs from an orthodontic workflow. The Application is not a medical device, does not perform diagnosis, does not provide clinical recommendations, and does not decide on treatment procedures.
3. Grant of licence
The Provider grants the User a non-exclusive, non-transferable licence, limited to the duration of an active Subscription, to use the Application within the scope corresponding to the purchased plan, Licence Key, and activation limit, unless a particular plan expressly states otherwise.
The Licence is granted only for the internal use of the User or the organization for which it was purchased. Unless agreed otherwise in writing, the Licence does not allow the User to provide the Application to third parties as a service, rent it, sublicense it, or use it to develop competing software.
4. Activation and Licence Key
Use of the Application after the Trial Period may require entering a Licence Key and verifying it. For the purpose of verifying the Licence, the Application may send the Licence Key, a device or instance identifier, the Application version, the date of the last check, and technical information necessary to verify activation.
The Licence Key is confidential and the User must not share it with unauthorized persons. The Provider may deactivate a key where there is reasonable suspicion of misuse, circumvention of the activation limit, unauthorized distribution, or breach of these Terms.
5. Activation limit and devices
The Licence may be limited to a specific number of devices or activations. Device replacement, system reinstallation, or another technical issue may require an activation reset. The Provider may approve the activation reset if the Provider believes that the Licence is not being misused. Reset requests may be sent to [email protected].
6. Offline use
The Application processes photographs locally and does not require a permanent connection for each batch. Internet is nevertheless required to start the Trial Period, activate the Licence, periodically validate the Subscription, and obtain updates. After successful validation, the full paid Licence remains available offline for up to 72 hours. If the Licence cannot be validated after that period, the Application temporarily enters limited mode—currently up to five photographs per day—until validation succeeds again. 7. Prohibited conduct
- Copying, sharing, or selling the Licence Key to unauthorized persons.
- Circumventing licence control, the Trial Period, activation limit, or technical protections.
- Decompiling, disassembling, reverse engineering, or modifying the Application outside the scope permitted by mandatory law.
- Removing author attributions, protective elements, or licence information.
- Using the Application in a manner that infringes third-party rights, especially patient rights and personal data protection rules.
8. Data and local processing
The Application is designed to process photographs locally on the User's device. By default, the Provider does not have access to patient photographs unless the User provides them, for example as part of support.
The User is responsible for having a legal basis for processing photographs and for meeting the requirements of legal regulations, including rules for maintaining medical documentation and protecting personal data. Details are provided in the Patient Photos & Local Processing Statement.
9. Outputs and review
The Application may automatically detect photo type and crop or name files. The User is obliged to check the outputs. The Provider does not guarantee that every image will be detected or cropped without error.
10. Updates
For the duration of the Subscription, the Provider supplies updates necessary to maintain the agreed compatibility, security, and functionality of the Application and informs the User when they are available. The Provider may also supply other fixes and optional improvements. If the User fails to install a necessary update within a reasonable time after being properly informed of its availability and the consequences of not installing it, functionality may be limited and the Provider is not liable for a defect caused solely by that failure.
11. Termination of licence
The Licence may terminate upon expiry of the paid period, cancellation or non-renewal of the Subscription, breach of the Licence Terms, misuse of the Licence Key, or for other reasons set out in the Terms of Service.
12. Intellectual property
The Application, its code, design, models, algorithms, documentation, logo, and related materials are protected by intellectual property rights. All rights not expressly granted to the User remain with the Provider or its licensing partners.
13. Limitation of liability
The Application is provided as a technical tool. To the maximum extent permitted by law, the Provider is not liable for indirect damage, loss of data, lost profit, business interruptions, or damage caused by incorrect use, incorrect settings, missing backups, or unchecked outputs.
