1. Acceptance of the License Terms

By installing, activating a License Key, launching, or using the SmileCrop application, the User confirms that they agree to these License Terms. If the User does not agree, they must not use the Application.

2. Nature of the Application

SmileCrop is a desktop application intended for automatic cropping, sorting, renaming, and organization of photographs from an orthodontic workflow. The Application is intended for technical editing and organisation of image files, does not perform diagnosis, does not provide clinical recommendations, and does not decide on treatment procedures.

3. Grant of license

The Provider grants the User a non-exclusive, non-transferable license, limited to the duration of an active Subscription, to use the Application within the scope corresponding to the purchased plan, License Key, and activation limit, unless a particular plan expressly states otherwise.

The licence is for internal use by the User or the purchasing organisation, including work for its patients. Without a separate agreement, the application may not be rented, sublicensed or made available to third parties as a separate software service. This does not restrict lawful-user rights that cannot be excluded by contract, including legally permitted study of the program and interoperability.

4. Activation and License Key

Use of the Application after the Trial Period may require entering a License Key and verifying it. For the purpose of verifying the License, the Application may send the License Key, a device or instance identifier, the Application version, the computer name, operating system and associated network information. Details are provided in the Privacy Policy (https://smilecrop.app/en/privacy).

The License Key is confidential and the User must not share it with unauthorized persons. The Provider may deactivate a key where there is reasonable suspicion of misuse, circumvention of the activation limit, unauthorized distribution, or breach of these Terms.

5. Activation limit and devices

The License may be limited to a specific number of devices or activations. Device replacement, system reinstallation, or another technical issue may require an activation reset. The Provider may approve the activation reset if the Provider believes that the License is not being misused. Reset requests may be sent to [email protected] (mailto:[email protected]).

6. Offline use

The Application processes photographs locally and does not require a permanent connection for each batch. Internet is nevertheless required to start the Trial Period, activate the License, periodically validate the Subscription, and obtain updates. After successful validation, the full paid License remains available offline for up to 72 hours. If the License cannot be validated after that period, the Application temporarily enters limited mode—currently up to five photographs per day—until validation succeeds again. 7. Prohibited conduct

Copying, sharing, or selling the License Key to unauthorized persons.

Circumventing license control, the Trial Period, activation limit, or technical protections.

Decompiling, disassembling, reverse engineering, or modifying the Application outside the scope permitted by mandatory law.

Removing author attributions, protective elements, or license information.

Using the Application in a manner that infringes third-party rights, especially patient rights and personal data protection rules.

Except where permitted by mandatory law or a separate licence, the User must not reproduce, distribute, sell, rent, sublicense or make the Application, its models or documentation available to third parties beyond the licence granted. This does not prohibit installation copies or backups permitted by law or the licence. Third-party components remain subject to their applicable licence terms; these Terms do not restrict rights granted by those licences.

8. Data and local processing

The Application is designed to process photographs locally on the User's device. By default, the Provider does not have access to patient photographs unless the User provides them, for example as part of support.

The User is responsible for having a legal basis for processing photographs and for meeting the requirements of legal regulations, including rules for maintaining medical documentation and protecting personal data. 9. Outputs and review

The Application may automatically detect photo type and crop or name files. The User is obliged to check the outputs. The Provider does not guarantee that every image will be detected or cropped without error.

10. Updates

For the duration of the Subscription, the Provider supplies updates necessary to maintain the agreed compatibility, security, and functionality of the Application and informs the User when they are available. The Provider may also supply other fixes and optional improvements. If the User fails to install a necessary update within a reasonable time after being properly informed of its availability and the consequences of not installing it, functionality may be limited and the Provider is not liable for a defect caused solely by that failure.

11. Termination of license

Cancelling future subscription renewal does not itself end already-paid access. The licence remains usable until the end of the paid period unless another lawful or contractual ground applies, such as a valid withdrawal. Original photographs and exported files remain in your storage after the licence ends; opening them in an ordinary image viewer does not require a SmileCrop subscription.

12. Intellectual property

The Application, its code, design, models, algorithms, documentation, logo, and related materials are protected by intellectual property rights. All rights not expressly granted to the User remain with the Provider or its licensing partners.

The Provider acquires no rights in the User’s input photographs or exported photographs merely because they are processed using the Application. Restrictions on distribution of the Application do not prohibit lawful use, storage or sharing of those photographs. Rights of patients, authors and other third parties remain unaffected.

13. Limitation of liability

The Application is provided as a technical tool. To the maximum extent permitted by law, the Provider is not liable for indirect damage, loss of data, lost profit, business interruptions, or damage caused by incorrect use, incorrect settings, missing backups, or unchecked outputs.

Nothing in these terms limits mandatory consumer rights relating to defects or liability that cannot lawfully be excluded or limited, including harm caused intentionally or by gross negligence or harm to a person's natural rights. The duty to review outputs and back up files does not remove the Provider's responsibility for application defects.
